The 35th Legislature of the Virgin Islands, led by Senate President Novelle E. Francis, Jr., discussed rezoning requests in St.Thomas. They considered Bill No. 35-0130, which proposed a zoning use variance for a scenic lookout with a restaurant/bar and gift shop, but was met with opposition from the Department of Planning and Natural Resources (DPNR) due to concerns and opposition from nearby property owners.

Bill No. 35-0135, which aimed to grant a use variance for a fuel storage facility in a commercial zone, received a more favorable response from DPNR and was presented by Keshoy Samuel. During the session, David Silverman proposed an alternative to the St. John land exchange, suggesting the conveyance of a 13.2-acre parcel in Estate Carolina instead of Whistling Cay. However, the legislature clarified that they do not negotiate and cannot act on alternative proposals.

In the end, Bill No. 35-0130 and Bill No. 35-0135 did not pass, while Bill No. 35-0112, which concerned the conveyance of Tract No. 02-101 Whistling Island in exchange for a portion of Tract No. 01-137A Catherineberg was approved and will be sent to the Governor for further approval.
